Just to keep people up to date....

Have talked twice with the IFA... (including today at 2 pm (well to be truthful they phoned me)

They have contacted Prospect Union rep Dave Allan, who has said he will look into it. I have staed that unless Prospect move on this - BAJR will be unfortunately forced to act unilaterally.. It would be better if Prospect backed up by the IFA and BAJR sorted this out, as it would be a precedent for strong combined actions.

If nothing is heard from Prospect by Wednesday, then there is no other choice for BAJR to act alone... and I will do all I can... Deep will be talking to me on Wednesday Night. so cross your fingers. I always keep my promises. Wink

Before you get too pious about this and wade in, what exactly have this unit done wrong legally? They have offered a fixed term contract with a clear end date. They have indicated that they will let people know whether there will be further work when they know what the situation is - from direct personal experiuence, being able to predict the archaeological market three months in advance is more than crystal ball gazing - and as far as the postings indicate, they have not said they will not re-employ people and not be offering holiday pay. So what is the issue you hope to deal with at this stage?

Hold on there VOR, what they have done is to take on a long term contract that is to last until the end of Febuary but, they are only offering the diggers a fixed term contract until the end of December.
This is only being done to keep costs down as they had to trim all costs to win the contract, I personally feel that they have really underbid and now having won the job need to make some serious savings, naturally the staff won't be expected to feel the pinch but the people at the bottom of the trench will!!

Well, you hold right on there too, Deepdigger. Have a look at Trowelhead's post, who is one of those affected. No mention of a project lasting till February there, rather a pragmatic approach to the issue of matching staff resources to actual work available.

Fear not VOR... no wading in has happened.

The actual legalities have been checked with ACAS and are currently being looked into by Prospect and the IFA...

the contracts are continually extending ones, and with work into february, and the implications that re-employment will be forthcoming in the new year, the actions of laying off people on the thursday before Christmas are a carefully calculated act to ensure that there is no 'continuince of employment' thereby no working rights are available. so you have Christmas and New Year with no pay. Happy Christmas. I suffered from that in the past as well... but mostly this legally correct but morally questionable act was consigned to the dustbin of history.

Perhaps it is all a big misunderstanding, perhaps there is a perfectly reasonable eexplanation, but if there is, they are certainly not letting the Fixed Term workers know about it. And with changes to their contracts without prior agreement they are breaking employment law.

So hold on, and lets see what happens, I wade in with both eyes open.. it gets you further in the end than a spikey club.

Such practices, although probably perfectly legal, are certainly unprofessional, and would be appropriate circumstances for the IFA to intervene.
