Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 Hello Tillet, You dont seem to have any positive comments about people who are self employed. what kind of support do the unions give to self employed people. You say that there are advantages to an employer but the correct self employed term is client. To succeed in a competitive world there should be an advantage to a client selecting your services. You seemed to be suggesting that people who are selfs are tempted to avoid paying taxes which isn’t very nice. I would say that they are taking responsibility for paying it. PAYE is a throw back system for factory workers where the government and the bosses invented income tax for the masses then patronised them and kept them in the dark. Have you checked your code recently, I think you should. Why for instance cant you claim your costs to and from work. I wouldn’t say self employment is rosy, for instance you have to keep a continual eye on changes each year made by the inland revenue to keep abreast of legitimate expenses. Do you do that? In most industries, doctors, architects, there are professional bodies who advise their members about the changes and consequences. They also lobby and directly negotiate on the principles of professional individual identity. So for example architects are not involved in CIS but archaeologists haven’t got a clue and the only reason that I am not in CIS is that I rang somebody up and they said that I was the same as an architect. I did not question the logic but it would have been nice if it was confirmed by a professional body particularly as there are a lot of so called archaeologists who go about imaging that we are a subsection of the construction industry positively begging it would seem to take alcohol and drug tests and learn about how to pour cement safely. Unfortunately the obvious professional body for archaeologists was established with council and government run units in mind and has dug that hole deeper with its name change. Although Hosty would appear satisfied with its advice for the self employed which makes it alright then. What I would want from a union is protection from having my self employed status questioned. What happened in the construction industry is that a lot of them went a step further than self employed and became limited companies as well. One of the problems with self employment is that it is barely mentioned in statue. It is still a very new taxation concept unfortunately mostly administered and advised by people on paye badly. You have documentation to prove the lack of need to be in the CIS? Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 I called Helpline on Tel 0845 366 7899 they told me I come under professional work like architects' services I have phoned twice. In both cases got the same answer. The clients were also the landowners which all my clients are. The examples were evaluations and watching briefs. in no circumstances was I anything to do with construction. Employment Rights for 'self-employed' - Unite Union does its stuff - brazier - 5th March 2010 Ok. Maybe you were in luck that day, reminds me slightly of the time when I once registered for benefits and nearly got put under archbishop category in the big DSS book of jobs. I take it you have written confirmation of that? Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 like I said it would have been nice if it was confirmed by a professional body, but I see no reason to argue with the inland revenue help line. Do you work directly for the landowner? Do you have cis registration? Employment Rights for 'self-employed' - Unite Union does its stuff - brazier - 5th March 2010 No so not relevant to me. Interesting information though. Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 have you got the appropriate cards, what they for Employment Rights for 'self-employed' - Unite Union does its stuff - brazier - 5th March 2010 Your posts are coming through in parts, slightly confusing! I have CSCS, since I have worked on sites requiring that type of card and induction. I think you are talking slightly at cross purposes to the main thread though. It's a different issue working for oneself doing small scale works prior to or apart from the main construction process, the thread's about those who may be in the main construction process being bogus self employed, and thus having normal rights removed. And in that respect this union had done its job well, though clearly employers will still seek to save money somehow and aren't going to roll over immediately. Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 Not sure what you mean by the main construction process. I understand that there are issues in the construction industry about bogus employments which is what the CIS card is all about but as I said archaeologists are not considered part of the construction process-we tend to deconstruct. I dont see anyway in which the union has done the subject of self employment in archaeology any favours by considering archaeology as part of the construction industry. What unions seem to be doing is saying you must be a worker which basically precludes there must be a boss. I dont need a boss to do archaeology I need a client. I am a professional archaeologists. I had to inform the National insurance before I undertook work. even digging work or else I would be fined. Employment Rights for 'self-employed' - Unite Union does its stuff - Unitof1 - 5th March 2010 Another way to look at self employment, which is basically about self assessment is to consider whether it makes you more "employable" in other jobs, for instance go to http://www.myjobsearch.com/ and type in "self employed vacancy” |
