BAJR payscales 08/09 consultation - BAJR Host - 12th March 2008 IFA have come back on the holiday question "our current recommendation of 20 days plus 8 bank holidays is 4 days above the legal minimum." so in 2007 it was 20 days plus 8 public a bank. =28 and now in 2008 it is 24 days (legal minimum) plus 4 days bank holiday = 28 of course in 2009 we all have to give 28 anyway "No job worth doing was ever done on time or under budget.." This means that as a bear minimum, it would be legal to offer 16 days, plus the statutory holidays. The IFA is asking for a minimum of at least 20 days, plus the 8 statutory holidays, so is above the legal minimum with a total of at least 28 days, 4 days over the government's requirement. at least in 2009 the legal minimum will be 28 days... (which may be inclusive of fixed bank and public holidays) thus getting away from the confusion - the confusion comes from the base, the govt. website see it as 24 day (which CAN include the fixed bank and public holidays but could in reality be as high as 32 days) while the IFA see it as a base of 20 days that CAN'T include the fixed bank and public holidays which = 28 days well whatever... BAJR will agree with the sentiments... Do RAOs all give 28 days holiday then? .... I think I already know the answer to that. When holidays are taken are a matter for the employer provided that this is not used to stop people taking holiday. David statement "at least in 2009 the legal minimum will be 28 days... (which may be inclusive of fixed bank and public holidays)" is misleading. The requirement is for 28 days and bank and public holidays count towards this total. The proposals are a response to the fact that UK workers do not currently have a legal right to paid time off on public or bank holidays, and so some have to include this time off as part of their 20-day annual leave entitlement. The Department of Trade and Industry (DTI) was originally proposing to increase statutory annual leave in two stages, with the entitlement rising from 20 to 24 days on 1 October 2007, and a further increase from 24 to 28 days taking effect on 1 October 2008. However, following the latest round of consultation, a number of changes have been made to the draft regulations, including: Delaying the introduction of the second increase until 1 April 2009 Enabling payment in lieu of the additional holiday entitlement to continue until 1 April 2009, as a temporary measure aimed at helping employers with transitional arrangements Providing an incentive for early compliance with the regulations, so that employers that already meet the full requirements as at 1 October 2007 will be taken outside of the regulations, as long as they continue to meet them. --- You are quite right Peter that the 28 days will be 20 days plus bank/public holidays... where at the moment it is 20 day (including bank/public holidays) take me away and shoot me ...
