Its hardly occasional - in the normal commercial world the developer and the land owner are one and the same and are in agreement that the development should proceed and to do so have to satisfy the conditions imposed by the system. In the pipeline/energy statutory world the system is seeking evidence first of all about the proposed pipeline routes (and alternatives) from a developer who has to satisfy that request with evidence from "their" archaeologists in order to receive a consent which once approved gives the undertaker compulsory purchase rights over that route if they so require. There is a conflict in the authorising authority as the gas transporter is bound by statue to provide capacity in the transporter system and could be stripped of their licences if they are found by the government not to have provided this capacity!

I am unsure where this is going... the topic is about Contracts - to steer it into territory about specific groups.. copyrights and burning records.. hedgerows and the IFA.. is not addressing the issue.
This is not about pipelines per se .. this is about what is
a) legal
b) moral
c) acceptable.
some stuff might seem rough... and yes it is... it is very rough... I would hope that the contracotr is not all that chuffed either.. (after all.... they are not getting paid for this time either) there are basic rights though... and also reasonable expectations where this should be costed in ... if a group are not paid for anything during this time and then taken back on again and expected to be grateful... pah... this is morally wrong... they should at least get the legal minimum.. and as the contract continues... they should get the same as full time staff (ie... the same holiday rights - even if this means they only get 3 days holiday... and they get no other pay.. as they have not accrued enough holiday time... 1.666 days per calender month)
Anyway I digress...
this is not about not getting a look in on pipeline contracts... it is about what is 'right' and how to deal with it.
You may think you are looking at the underlying cause.. fair point... but lets stay firmly on topic and in the AUP.

I think you will find, if I interpret all the opaque allusions correctly, that the problem here is that the company in question had work suspended as a result of the weather (to protect the landowners, coincidentally), with no clear date for a restart in the New Year. This does not appear to be a case where contract dates are used with intent to avoid holiday pay but rather an unfortunate coincidence of circumstances. In such a case, they seem quite legitimately to have exercised their right to give notice as per any agreed contract terms. Unless of course those affected can demonstrate that they are getting new contracts beginning immediately after the Christmas break? In which case my understanding goes out of the window.
btw I do not work for them!

Ah Voice of Reason ... you have broken cover with your intimate knowledge of the situation and I now know who you are lol
But while the details of what you say "may" be true, it will be interesting to see how the archaeologists will be re-employed next year....assuming they will be of course...but I suspect that they will be asked to continue their work and as I said before in an earlier comment.... if the archeaeologists dont like it, the go elsewhere, where they will be welcomed......I am sure that there will be lots of work next year.....

Nice to see the topic back on course - seemed to have temporarily undertaken a life of its own!
And in responce to the problems with landowners/no clear start date back after christmas etc there does seem to be a tremendous amount of foresight in that when the contracts were issued the idea of no return in the new year was supposedly not known - how lucky they put that small phrase in before it happened!
It comes down to an issue i raised previously - the idea of being given the appropriate information about the conditions/lengths/certaintly of a job before accepting.
Just asking for a bit of fair play. The wages in archaeology are set at a level (tho hopefully will improve eventually) where there is no safety net and decisions between jobs and timing are incrediably important.
Units you have a moral obligation to treat people as people or the skills drain youve begun will only worsten!!

Thats really where we are just now. things can only get better... for to continue we can only end up making ourselves unimportant and sidelined.
It was not that long ago (well ok... maybe around 13 years ago) I was on a pipeline near York... we had time money and resources... big money to pay for good workers.. good resources to get the job done quickly and efficiaently... we had time to do it and resources to do post-ex... think we had about 20 folk on one site... an Iron age settlment.. we were there for about 8weeks or more (all a bit hazy!) And did a agood job with trowels... rather different now I fear? sampling, percentages and bottom dollar as the lorries move closer.
