All I am saying in this... is I am aware about where this comes from... have given advice and I can only say that the advice was the archaeological contractors to ensure they have there own drugs (and drink) policy - and as such.. whoever they are working for have no legal right to enforce their own drugs policy.
You do have the right to refuse a drugs test, but as such are open to dismissal due to refusal.. however you are not dismissed for drug use... only for refusing.
I think we are all adult enough here to admit we are in a situation where often.. temptation for a weekend spliff is great.
The question is should having a pint (or 2) on Saturday will affect your ability with a shovel on Monday... same for anything... If you are in any way affected by even a hangover.. and the position you have is one where negligance could cause harm to another... you'd be oooot. However I have myself spent many a hungover morning... troweling gently.... I was no harm to anyone... but the director was right to bollock me for not being up to spreed on his site... fair point.
Remember... DRUGs are illegal.... Drinking or being under the influence of drink on site ranges from stupid to dangerous.
You have personal freedoms, but also you have a duty of care to all who are relying on you to either put in a full days work.... or work a mini digger!
