I agree entirely with Kevin.
The trade union can also advise on the 'no contract' point as well. I think it has been discussed elsewhere (possibly eithin this thread...) that there is a contract of employment between employer and employee even if there is no signed piece of paper. The union can advise, but I think the general principle is 'like for like' and 'reasonableness'. Personally, I wouldn't think that less than a weeks notice of layoff is reasonable notice! I can entirley understand the anger and frustration!

Agreed Kevin and oldgirl. My posting there may have been overly hasty and ill considered. I think that I was just annoyed at Monty's treatment as a casual worker who is unworthy of respect. Certianly see what Prospect has to say; they certainly know their employment law. I'd join Kevin in advising people to join: its not much money and they cover you for all kinds of things. More reliable advice than mine, for starters!

Monty, you have my sympathy as I have just bin laid off as well after a weeks notice ("but we'll take you back on as soon as the work picks up")-you never get used to it.
Good advice about prospect though,have just e-mailed them myself about joining and would recomend to anyone now about doing the same.
As for work i'll be very surprised if it picks up this side of Xmas,more like in the new financial year as a lot of clients are holding off till then.

Yes yes yes to joining prospect! Everyone should join and then we would be able to overcome the huge hurdle presented by a transient workforce not having enough members in units without a permanent digging/fieldbased staff. There is strength in numbers and i cant think of a better way to invest 5pounds a month( and they reduce it if youve got no wages coming in).
And prospect pull your finger out - get a recruitment drive going!

I completely agree. And they can advise on lots of things, not just pay and conditions. And the more people they have the stronger the case for them taking on some of the really appalling problems that people are having. Plus they offer free training and personal support.
The only reason I'm an ex-member (actually of IMPS, which is what they use to be) is that when I became a 'boss' they felt it wasn't really appropriate for me to stay in, but I continued to have regular contact with them to ensure that decisions that we made were appropriate.

Oldgirl and Trowel etc.. they tell the truth folks... JOIN PROSPECT... they can't represent you if you are not a member.. and no point waiting til it goes pearshaped... as they can only help from when you are a member....

When I was a member of prospect I was often heard to say PROSPECT....where are you???
Might join again though as at least they have honest and moral intentions and no hidden agendas...

How do you stand on this issue if you are writing up a site report from home, and have been allowed a set number of days and a deadline but no other restrictions? Would this be considered self-employed?

Not on the info you have given. If you have first informed the tax man then gone round advertising to different units to undertake report writing best based on price and could show interest from at least more than one you might have a start but you might find it not worth all the tax form filling in hassle.

You... as a self employed person will say how long it will take to do... you can be given a senario of... this is the budget... can you do it in that time... in which case you would decide, Can I do it in the time? if I do it quicker will I still get the same ammount of money... if it takes me longer ... I will lose money... If I have to correct anything, will I have to do it for nothing... what are my terms etc...
So sounds like you are still employed to me.
