As I said there is no breach of the Copyright Act providing that the document is being consulted for private and/or research purposes. Troll's original request was how could excavation staff get to see this document to check on H&S procedures. I would count that as research.
I think that commercial organisations should buy their own copy and don't see any reason why SCAUM, BAJR or anyone else should subsidise them.

Copyright is a very complex beastie ! Terms such as "in the public domain" and "fair dealing" are much mis-used and mis-understood.
Fair dealing generally means quotations or excerpts can be copied and used. In libraries this is usually interpreted as 1 article or 1 chapter per book/journal issue per person. Most education institutions and reference libraries have copyright compliance agreements which enables teachers etc to make multiple copies for distribution to students but rules are quite strict. In any case copying a whole book for distribution without permission from the authors/copyright holder would contravene copyright, even in the circumstances suggested above. Copyright protects authors/publishers moral rights to their work as well as financial so even though it is less likely to go to court, it would be perfectly valid and possible to sue even if no financial loss could be proved.
Having said all that (with my ex-librarian's hat on) I would agree that it would be a good idea for more detailed H&S info directly relating to archaeology were availalbe in the workplace. Where I work the obligatory H&S at Work posters are in place, both in the main offices and temporary cabins, but not job specific H&S information. I don't think SCAUM has a website but, depending on how large the document is, perhaps they could work alongside the IFA on this to publish online either directly on a web page or as a downloadable pdf.

This is the point SCAUM do not have a web site. The publication is an electronic one encouraging duplication. The BAJR site is ideal for this kind of thing.

Well, if the copyright issues could be overcome (or ignored without fear of legal action), I would like to see the manual made as widely available as possible.
It rather begs the question of why the H&S manual of the Standing Conference of Archaeological Unit Managers does not seem to be widely available to the staff of archaeological units.
On the question of joining SCAUM - can you join it as an individual if you are not a manager of an archaeological unit? Do they have qualifying criteria?

According to the Current Archaeology web site:
Membership of SCAUM costs ?40 per annum and is open to the managers of all archaeological organisations.
I guess BAJR counts as an archaeological organisation.
On a wider point I really don't understand why we are having this discussion in isolation. I know for a fact that members of SCAUM 'lurk' on the BAJR site. Why not one of youse give us a straight up view on whether SCAUM would be willing to allow BAJR to host the H&S manual?

Sorry kevin, I did not make myself clear. If the SCAUM document is used as the guidance on H&S matters on a commercial contract, then that cannot be a private or research use. Secondly, what is the legal standing of the document? Does the HSE recognise it, would a court recognise it if someone challenged the H&S provision on a site (perhaps following an incident)?
If it not the document used by an employer, and declared to be the standard used, and/or if it hads no legal non-optional standing, there is no point in trying to use it to challenge an employer's H&S provision.
If it is declared to be the standard, or is recognised by proper authorative bodies as being the defining standard, then yes, it should be available to staff by one means or another.

I don't have an updated copy but the third edition (1997) was produced by JL Allen and A St John Holt of Hanscom Network Ltd, a H&S consultancy. Both authors are FIOSH RSP - Fellows of Institute of Occupational Safety and Health and Registered Safety Practitioners.
The great value of the manual was that it was written by H&S consultants with archaeological interests (plus input from archaeologists). Also, in the ever changing world of H&S, it provided up to date revisions and amendments. Many units write H&S policy docs and manuals that very quickly become out of date. To keep these docs up to date requires regular monitoring of the HSE site. I fear there are few units that do this.
BTW some of our taxes went into the production of the SCAUM manual - it was supported financially by English Heritage!
