The Institute of Historic Building Conservation has flagged this one and I imagine that ALGAO are also lobbying strongly about it behind the scenes:

Basically, Listed Building and Conservation Area legislation can be ignored by the neighbourhood planning provisions within the Localism Bill. One also assumes of course that provisions in PPS5 covering archaeology are also ignored. Hopefully it's just the DCMS forgetting to get involved and it'll be sorted out before the Bill is finalised.
